I – As a User, Registered User or Private Customer using our Website and Apps

  • idealista will be responsible for processing the personal data you provide when requesting any of our services. Therefore, we will process your data primarily for the purpose of fulfilling the contractual relationship established when you request a service from us.
  • Additionally, we will send you promotional communications about idealista products similar to those you have requested, taking into account your consumption habits and preferences. We carry out this activity because we have a legitimate interest in maintaining our relationship with you by informing you about new products you may be interested in. However, you can unsubscribe from these communications at any time.
  • If you have expressly requested a service provided by other companies, or if you authorize us to do so, we will share your data with those companies so they can provide the service to you.
  • You may access, rectify, or delete your data at any time, as well as exercise other rights (as we will explain below).

II – As a Professional Client or their representative using our Website and Apps or our professional tools

  • idealista will be responsible for processing the personal data you provide for the provision of the service contracted by you or by the entity you represent.
  • If the service is contracted by you personally, we will process your personal data in order to provide the requested service. However, if the service is contracted on behalf of your company, we will process your data based on our legitimate interest. We do this because there is a legitimate interest (both from your company and from idealista) in managing the provision of services.
  • If you have expressly requested the contracting of a service offered by third-party entities that collaborate with idealista, your data may be shared with those companies so they can provide the service requested by you or by the company you represent.
  • You may access, rectify, or delete your data at any time, as well as exercise other rights (as we will explain below).

1. Data controller: Who is responsible for processing your data?

IDEALISTA – SOCIEDADE UNIPESSOAL LDA, headquartered at Avenida da Liberdade, 249, 5th floor left, 1250-143 Lisbon, parish of Santo António, municipality of Lisbon, with NIPC 513131434 (“idealista”), is the entity responsible for processing the personal data you provide through our website or applications (“Website and Apps”). Among other responsibilities, idealista is the entity responsible for:

In the following clauses, we provide information about your rights as well as how we will use your personal data when you browse our Website and Apps to search for information on listed properties or to list a property yourself (“User” or “Registered User”), whether you contract our services as a private individual (“Private Client”) or as an independent professional or representative of a company (“Professional Client”); all under the European General Data Protection Regulation (“GDPR”), Law No. 58/2019 of August 8 on Personal Data Protection, and other applicable national laws.

2. Data categories: what personal data we use?

When you use our Website and Apps, we may access certain personal information and data that belong to you. Throughout this text, we will explain the type of personal information that will be used in each case.

Categories of personal data we may use:

  • Identification data: full name, identification document (citizen card/passport/tax ID), profile photo, handwritten signature, voice (in case of phone contact and call recording), and your user ID and password.
  • Biometric data: traits, pressure, and speed of the electronic signature.
  • Contact data: phone number, email address, and mailing address for contact purposes.
  • Personal characteristics: age, gender, profession, and your co-living preferences, when searching for a room or rental property.
  • Economic and financial data: your card or bank account details and your billing address when contracting a payment service. You may also provide information about your income, but only if you want to qualify your search profile for a room or apartment to rent.
  • Interaction and navigation information: interaction and navigation data from the Website and Apps, IP address, and audience data. For more information, you can also consult section 10 of this Privacy Policy and our Cookie Policy.
  • Commercial information or related to the services you contract: full information about the properties you will list (including their physical address) and information derived from the contracted service (e.g., saved search filters).
  • Information specifically affecting Professional Clients (legal entities): if you contract any of our services as a Professional Client (legal entity), we will process the following information related to the representative(s) (natural person): full name, citizen card/passport/tax ID, phone, contact email, and in some cases, documents proving representation authority.

At idealista, we will process your data for the following purposes:

3.A) Processing necessary for the provision of the services you request

There are certain data we require as “mandatory” because they are necessary to provide you with the services you request.

The list of services we offer includes:

  • Registration as a Registered User on the Website and Apps. You can create an account using your email address or log in via Google or Apple. If you choose the latter, you will be redirected to the respective platform to complete authentication with your credentials. Based on this information, we will generate your account on our Website and Apps, using some basic data such as your username. In some cases, this username may be visible to other users within the Website and Apps, but no other information obtained via Google or Apple will be shared. You will always have the option to unlink your account at any time from your profile settings.

Additionally, note that registering as a Registered User of the Website and Apps implies your acceptance of receiving any transactional communications related to its operation or any other contracted service (these transactional communications relate to managing and resolving potential technical issues, notifications in case of changes to contract conditions, or the management of any complaint you may need to file regarding service contracting).

  • Service to save and manage your searches as a User, whether registered or not.
  • Service for publishing listings on the Website and Apps. We will also process your data to issue invoices for the services provided, if applicable.

If you want to publish properties on our Website and Apps, we may request certain information to carry out a verification process (“Know Your Customer” or KYC) to ensure you are a legitimate advertiser. This verification allows us to:

  • Fulfill our contractual obligations, ensuring the services are properly provided.
  • Comply with applicable legal obligations, including those related to fraud prevention and other regulations governing the digital and real estate sectors.
  • Protect our legitimate interest in ensuring the quality and proper functioning of the Website and Apps by preventing fraudulent ads or those that violate our terms of use.

This validation process may require additional documentation to verify your identity and the legitimacy of the published listings.

  • Property valuation service (not conducted by a certified real estate appraiser).
  • Multimedia services to help improve your listing (pics & plan, video, virtual tour, 3D, etc.).
  • Property export service.
  • Support service to help you sell or rent your property, if you are a Private Client.
  • Advanced handwritten biometric electronic signature service, which can be used by Professional Clients to offer their own clients, via idealista/tools, a document signing service related to the sale or rental of a property. In this case, we act as a data processing subcontractor for the data included in the documents to be signed. The rights and obligations of Professional Clients arising from the idealista/tools service are included in the subcontracting agreement signed when contracting idealista/tools.
  • Duplicate detection service (DeDup) to identify duplicate listings from various internet sources. When providing this service, links to third-party websites or web applications may be displayed. idealista has no control over and is not responsible for the content or legal compliance of such third-party websites or applications, so we recommend you carefully review their privacy policies and terms of use.
  • Monitoring compliance with the Website’s terms and conditions. This includes supervising contact forms, chat, and other communication tools, as well as analyzing overall platform usage. This monitoring is carried out to ensure compliance with your contract with idealista and, as explained further in this Privacy Policy, to detect and prevent improper activities, ensure user security, and improve service quality.

Note that if you request these services, we will use your identification data, economic data (if payment services are involved), and information we may have about your properties. We will also use your contact data to communicate with you by phone, SMS, or email (if you have provided any of these), when necessary to provide these services.

In some cases, such as managing payments or refunds through the app, we may share information related to contracted services with third parties like Apple or Google (Android), as necessary for proper processing.

For contracting and providing certain services, it may be necessary for idealista to share your personal data with third-party entities we collaborate with so they can respond to your request.

For these additional services, your identification data, contact data, and any information we have about your property will be used.

3.B) For idealista’s legitimate interest

We will detail and explain the different circumstances in which we may process your data based on a legitimate interest:

We will process your identification and contact data to (i) formalize, including through electronic signature systems (our own or third parties’), the contractual relationship with the entity you represent; (ii) maintain necessary communications with you to provide services to the said entity you represent; or (iii) manage any request you make on its behalf.

In accordance with the GDPR, we have conducted what is known as a “balancing test”. This is an internal analysis to confirm that our legitimate interest does not prejudice the interests of the data subjects in protecting their personal data.

As a result of this test, we consider that idealista’s legitimate interest prevails, due to the mutual interest in ensuring proper representation and interaction with a legal entity to adequately manage the contractual relationship with it.

Data we process: your identification and contact data.

If you are a Private or Professional Client

If you decide to be an advertiser on our Web and Apps, we may request additional information from you to carry out a verification process (“Know Your Customer” or KYC) in order to ensure that you are a legitimate advertiser. This processing is carried out to comply with our contractual and legal obligations, as well as to ensure the proper functioning of the Web and Apps. We have a legitimate interest in conducting this process because it is necessary to prevent fraud, ensure that advertisers are genuine, and comply with applicable regulations.

On the other hand, we will process your data to manage claims for amounts that may be owed for our services. This processing is necessary both to ensure compliance with our general terms and conditions and to guarantee the company’s solvency in the face of possible payment defaults.

Both processes (KYC and management of claims for amounts owed) are carried out under a balancing test, as a result of which it is understood that our interest in carrying out these activities prevails to:

  1. a) verify that you are a legitimate advertiser through the KYC process;
  2. b) collect unpaid payments for the provision of our services;
  3. c) enforce the general terms and conditions of our service contracts; and
  4. d) ensure that the company’s solvency is not compromised by these debts.

In this regard, we understand that we have a legitimate interest that does not affect your privacy, since this processing does not harm your fundamental rights and freedoms and, furthermore, we will only use the minimum data necessary to verify your identity (KYC) and collect the amounts owed.

Data we process: your identification data, contact data, financial data, as well as any other information necessary for the KYC verification process.

If you are a User (and you accept the use of analytical cookies, preferences, automatic personalization, and advertising)

Idealista may create profiles based on your behavior. Specifically, for this activity, idealista will process data obtained from observing your browsing habits on the Web and Apps, as well as monitoring and analyzing your behavior while navigating these environments. With this information, which comes from idealista’s internal sources (i.e., data we obtain directly from you without consulting any third-party files or databases; for example, data you provide when contracting any of our services), we will analyze your interests to determine which of our products and services best fit your profile, in order to show you recommendations within the Web and Apps that match your preferences and send you certain promotional communications.

No automated decisions based on this profile that produce legal or significant effects for you will ever be made.

This processing requires your prior acceptance of cookies in terms of consent, so idealista will process the personal data obtained through the use of analytical cookies, preferences, automatic personalization, and advertising, provided that you have given your express consent for these purposes through the cookie settings panel. For more information, you can consult our Cookie Policy.

If you are a User or Registered User, we may also use your data to collaborate with third parties such as Google Ads, Meta, TikTok, and LinkedIn to create audiences and measure enhanced conversions, provided that you have previously (i) given your consent for the use of cookies or (ii) the data has been anonymized and shared in a “hashed” form, always ensuring the privacy of your information.

This processing will allow us to run advertising campaigns and offer relevant content on third-party platforms based on your preferences and interactions on our Website and Apps. Such content may relate to idealista’s products and services that we consider of interest to you, according to your browsing habits, with the goal of providing a more personalized advertising experience tailored to your needs.

Furthermore, to improve conversion measurement and assess the effectiveness of our campaigns, we may use certain interaction data on our Website and Apps, always ensuring encryption and secure processing.

We have conducted a balancing test to ensure that this processing does not affect the fundamental rights of data subjects. In this regard, the data is used in a limited, proportionate way and exclusively to personalize and improve the User experience. Naturally, when using data from cookies, we ensure to obtain the User’s express consent, in accordance with applicable law.

Data we process: your identification and contact data, personal characteristics, interaction and browsing information, and commercial information.

If you are a User or a Registered User, whether a Private or Professional Client

We will send you promotional communications about idealista’s own products and services related to those you initially contracted, unless you exercise your right to object to this processing. You can opt out of receiving these communications at any time, for example, by clicking the unsubscribe link included in the emails.

To send you these communications, we will take into account the commercial information stored about you in our internal sources (such as cookies you have authorized, the data from your profile created on the Web and Apps, the searches you have made, the properties you have saved as favorites, or the contacts you have made with advertisers). This allows us to send you communications tailored to your consumption habits and preferences, as well as to carry out quality surveys about the services you have contracted with idealista, with the aim of receiving your feedback and improving our services.

In this case, we also carry out a balancing test and, as a conclusion, we understand that our legitimate interest prevails in carrying out this processing for:

  • to maintain the relationship with you through the contracting of new products;
  • to know your feedback regarding the services provided; and
  • to make the appropriate improvements based on the suggestions you have made about the contracted services.

In light of the above, we understand that we have a legitimate interest that does not affect your privacy, since for this processing we only use the data you have provided to us or that have been generated in the contractual relationship (excluding those obtained from external sources).

Data we process: your identification data, contact data, data related to the services you contract, and commercial information.

For all Users

Prevention of improper practices:

We process your data to verify your identity, prevent abuse and fraud, and maintain a safe and reliable environment for Users on the Web and Apps. This may involve processing your data even after you cancel your Registered User account (during the period specified in clause 6 below), as well as reviewing internal messages (chat) on the Web and Apps, as explained in point 10.b) of this Policy.

If any attempt of fraud affecting your personal data is detected, and unless there is a public interest circumstance or another legal cause preventing it, we will inform you, analyze the available information, and when appropriate, may request your cooperation and additional information.

As in previous cases, we have also carried out a balancing test here to ensure that our interests in fraud prevention do not harm the rights of our Users.

Thus, our conclusion is that our interest prevails, as this is a necessary measure to safeguard the security of our Users and protect the integrity and operation of the Web and Apps.

Data we process: identification data, contact data, data related to the services you may have contracted.

Blurring of images in ads:

To guarantee privacy and compliance with applicable regulations, we may apply blurring techniques to images included in ads that may contain sensitive information, such as vehicle license plates or people who were captured accidentally. Generally, these types of images are not allowed and may be removed from the Web and Apps. However, in cases where they are not removed, we may apply this anonymization technique to avoid exposing personal data.

Data we process: images contained in the ads.

What data do we process?

Your identification data, contact details, economic data, and information about the services you contract.

For what purpose?

To comply with the various legal obligations required of us and when requested by any Court, State Security Force, or any other competent Authority or Public Administration.

If you expressly consent, we will process your data for the following purposes:

  • If you are a User or Registered User and select a property and wish the advertiser to contact you, we will share your identification and contact data with the corresponding Private or Professional Client. Additionally, we may share with the advertiser the search filters you used to find your property.
  • If you send us a request, complaint, or inquiry via email or contact form, we will process your identification and contact data to manage that request or inquiry.
  • For documents we ask you to formalize through advanced electronic signature, we will use your biometric signature, provided you have explicitly authorized us, in accordance with Article 9.2.a) of the GDPR, as this involves a special category of personal data.
  • For the qualification of your tenant profile. As a user looking for a room or a rental property, we will share the tenant profile you have created (including your identifying, contact, personal, economic, and financial data) with the advertisers you specify.

  • If you are a real estate professional, you may participate in webinars we organize if you authorize it through the registration form we provide.
  • If you contact idealista by phone, the call may be recorded for service quality purposes. At the start of each call, you will be informed about the recording and asked for your consent to continue. Recordings help optimize contract follow-up, quickly resolve incidents, and maintain service quality.
  • If you are a Registered User, Private Client, or Professional Client, we may contact you by phone, SMS, or email (if you have provided any of these), to send you commercial communications you have accepted, particularly to:
    • Send you commercial communications related to other products offered by idealista (different from those you have contracted) or companies within its economic group, namely Idealista, Intermediário de Crédito, Unipessoal Lda., and Smiling Cloud, Unipessoal Lda.
    • Send you special offers from companies that can assist you in the process of selling or renting your properties (real estate agencies, developers, energy sector companies, insurers, consultants, and appraisers).
    • Send you newsletters from idealista/news.
    • Request your participation in surveys and market studies.
  • If you are a Registered User, Private Client, or Professional Client, we may share your data with third-party companies so they can contact you by phone, SMS, or email (if you have provided any of these contact details) to send you commercial communications about their products and services. Specifically, we will ask for your consent to:
    • Communicate your data to third parties in the real estate sector, energy companies, insurers, real estate agencies, consultants, appraisers, and other companies not belonging to the idealista group so they can send you commercial communications.
    • Communicate your data to other companies within the same idealista group (mentioned above) in order to send you information related to their product and service offers, news, and other commercial communications.

For the purposes set out in this section, we will use your identification and contact data, or the information specified above, to qualify your profile, when you have authorized it.

In any case, idealista will request specific consent for each of the purposes we have just indicated. In particular, for commercial communications, if you are a Registered User or Private Client publishing on the portal, your consent will be given by ticking the box in the registration or ad subscription form shown in the “Settings” section. If you are a Professional Client, consent is given by ticking the corresponding box when you contact us or when contracting any of our services.

Additionally, we inform you that idealista has collaboration agreements with certain companies offering services that we believe may also interest you. These companies provide their services on our Web and Apps and make available forms so you can contact them directly.

4. Recipients: who might we share them with?

We may share your data with third parties in the following cases:

(i) Regarding point 3.A) above, if you are an Private or Professional Client:

  • With the agencies you select to assist you in selling or renting your property, when you request the corresponding support service, if you are a Private Client.
  • If you are a Professional Client, with the owners/managers of aggregators or real estate portals, for publishing your properties when you request the export service to other portals.

(ii) Regarding point 3.D) above (if you are a User, Registered User, Private or Professional Client):

  • With advertisers (Private or Professional Clients) you have contacted. For clarification purposes, we will share with those advertisers the contact data you provided in the respective form.
  • With third parties in the real estate sector, energy companies, insurers, real estate agencies, consultancies, appraisers, and other companies not belonging to the idealista group, if you have consented, with the purpose of sending you commercial communications.
  • With other companies in the idealista group (mentioned above), to send you information related to their product and service offers, news, and other commercial communications, if you have consented.

(iii) For the other purposes:

Your data will not be shared with third parties unless required to comply with legal obligations or if expressly requested by Courts or Public Authorities, as indicated in point 3.C). We will also share the data of the ads you have published with appraisal entities, based on their legitimate interest in identifying comparable offers that properly reflect the market situation.

Notwithstanding the above, service providers subcontracted by idealista who assist with processing, including those providing technology services or handling sending and receiving documents and tools to measure the functioning of the Web and Apps, may have access to your data. These subcontractors can only access your information following idealista’s instructions.

You may request more information about the recipients of your data by sending an email to privacidade@idealista.pt specifying the particular processing or use regarding which you want more information about the recipients.

5. Data transfer: where can we send your data?

Exceptionally, some of the idealista service providers referred to in the previous section may process your data in countries located outside the European Economic Area (“EEA”).

In any case, whenever we transfer personal data internationally, we will ensure that:

  1. a) the data transfer complies with the applicable law; and
  2. b) your data maintain the same level of protection as within the EEA.

To this end, we will only use providers that:

(i) are located in a country or territory that has been declared to have an adequate level of protection by the European Commission; or

(ii) provide us with adequate safeguards such as standard contractual clauses or a legally equivalent mechanism, sufficient to ensure that the third party protects your data and provides rights and protections at the same level as within the EEA.

This is without prejudice to the fact that we may also apply technical protections, such as encryption and pseudonymization of your data, as appropriate.

6. Data retention period: how long will we process your data?

Depending on each of the purposes for which we process your data, the retention period will be:

  • During the contractual relationship. That is, while you are a User, Private Client, or Professional Client (applicable to the processing referred to in section 3.A), which is necessary for the provision of the services you request from us.
  • Until the purpose for which your data was obtained ends or you object to its processing based on legitimate interest (applicable to the processing referred to in section 3.B), unless there are compelling reasons justifying the processing (for example, when it is necessary to prevent abuse or fraud on the Web and Apps, where we may retain your data for up to 4 years).
  • Until you withdraw your consent (applicable to the processing referred to in section 3.D, based on the express consent you have given) or one year after its recording, in the case of call recordings (also referred to in section 3.D).
  • Until you request its deletion, in cases legally permitted (applies to all purposes described in section 3).

We inform you that your data will be kept blocked at the end of the processing for which they were intended and during the statutory limitation periods of the obligations applicable to each processing purpose indicated in section 3 (generally a maximum of 6 years).

If you are a Private Client who has used the property listing service, free or paid, and ask us to delete your data, including your email or phone number, we inform you that we will keep said data blocked (i.e., encrypted and associated with an internal identifier) for a maximum period of 2 years from your last listing, in order to prevent misuse and/or fraudulent use of our free listing service. During this period, we may carry out security checks to ensure the correct operation of our services.

Similarly, if you are a Professional Client, we inform you that we will keep your email and phone number for a maximum period of 4 years from your last interaction with idealista, in order to prevent misuse and/or fraudulent use of our services.

In both cases mentioned above, a balancing test has been carried out to confirm that idealista’s legitimate interest in carrying out these controls does not prejudice the interests of the data subjects in the protection of their personal data. As a conclusion of this test, we consider that idealista’s legitimate interest prevails, since these measures are necessary to ensure the proper fulfillment of the conditions of our services, and only the minimum essential data is used so that no rights or freedoms of any kind are harmed.

7. Necessary and updated information

In the forms, there are fields that are mandatory to fill out, without which we will not be able to provide you with our services. By clicking the “Enter!” button (or equivalent) included in the aforementioned forms, you declare that the information and data you provide are accurate and truthful.

8. Data subject rights

You are informed that you may exercise the following rights regarding your personal data:

  1. Right to access your personal data to know which data is being processed and the processing operations performed on them.
  2. Right to rectify any inaccurate or incomplete personal data.
  3. Right to erase your personal data, whenever possible (without prejudice to cases where we must keep them blocked due to legal obligations).
  4. Right to request the restriction of processing of your personal data when the accuracy, legality, or necessity of the data processing is doubtful, in which case we may keep them blocked for the exercise or defense of claims.
  5. Right to object to the processing of your personal data when the legal basis for processing is our legitimate interest. idealista will stop processing your data unless there are compelling legitimate reasons or it is necessary for the defense of claims.
  6. Right to data portability, which allows you to request the transfer of your personal data to another company, in a structured, commonly used, and machine-readable format, when the legal basis for processing is the existence of a contractual relationship or your consent, and provided that the processing is carried out by automated means.
  7. Right to withdraw the consent granted to idealista at any time.
  8. Right not to be subject to automated individual decisions. This right allows you not to be subject to a decision based solely on automated processing of your personal data that produces legal effects concerning you.

You may exercise your rights at any time and free of charge in the following ways:

  1. a) From your private area on the Web and Apps. There, you can unsubscribe from all previously accepted commercial communications or select and customize the types of notifications you wish to receive from idealista.
  2. b) If you are unable to access the Web and Apps, you can send an email to privacidade@idealista.pt indicating the right you wish to exercise and your identification details.

Additionally, we inform you that you have the right to file a complaint with the National Data Protection Authority if you consider that there has been a breach of data protection legislation regarding the processing of your personal data.

9. Confidentiality and security

At idealista, we make all reasonable efforts to maintain the confidentiality of personal information processed through the Web and Apps, and, where applicable, other idealista tools. We maintain strict security measures to protect the personal data we process against accidental loss and unauthorized access, processing, or disclosure, taking into account the state of technology, the nature of the data, and the risks to which it is exposed. However, we cannot be held responsible for the use you make of the data (including username and password) that you use on idealista outside of our tools, Web, and Apps.

10. Additional information on certain features of the Website and Apps

a) “Send to a Friend” Form

idealista will not process the personal data of the friend you include in the “Share” form.

b) U of the contact form and internal messaging service (Chat) of idealista

To optimize your experience, Idealista provides an internal messaging service (chat) and message archiving through the Website and Apps, allowing Users, Registered Users, Professional and Private Clients to (i) initiate contact and continue communications, and (ii) access and store the conversations held.
